CES/4-WHEELER GIVEAWAY – OFFICIAL RULES 

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. 

Promotion Period: Promotion runs onMay 1, 2021 – August 1, 2021 (the “Promotion Period”), in the United States (“Qualified Country”).

Promotion: Three randomly selected winners will each receive one (1) 2021 Kawasaki Brute Force^® 300 KVF300CMFNN ($5,583.84 value)

Qualifying Locations:

Qualifying Purchase must be purchased during the Promotion Period. Limit 3 entries per customer. Void where prohibited.

Terms and Conditions

Promotions: CES conducts various promotions and giveaways (individually a “Promotion” collectively “Promotions”) on Facebook, Instagram, Twitter, or other social media platforms (each, a “Social Media company”). CES promotions are in no way companied by, endorsed by, administered by, or associated with any of the Social Media companies. By participating in the Promotion, you release the Social Media company from any liability related to or arising from the Promotion.

1. Eligibility:  CES Promotions are open only to legal residents of the United States (including the District of Columbia) who are at least eighteen (18) years old at the time of purchase (“Customer”).  The Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation in the Promotion constitutes Customer’s full and unconditional agreement to abide by these terms and conditions (“Terms and Conditions”), including the arbitration clause. Customer must make a purchase of qualifying items during the Promotion Period to be eligible for entry in Promotion. Proof of eligibility must be provided upon request.

• Limit: Customers are limited to (3) entries no matter how many modules are purchased or mailed entries submitted.

• How to Enter: Customers will receive one entry to the Giveaway during the Promotion Period for each purchase of 3.65KW of REC products (“Qualified Purchase(s)”) from City Electric Supply at a *participating branch location, or for those who do not wish to make a purchase during the Promotion Period, submit a 3×5 post card with the entrant’s name, date of birth and valid email address to City Electric Supply Marketing 400 S. Record Street, Suite 400, Dallas, TX 75202 postmarked on or before the end of the Promotion Period.  Entrants that are account holding customers at a participating branch location may also enter the Giveaway by making Qualified Purchases through City Electric Supply’s online store. Each Qualified Purchase or individually submitted post card will count as one (1) entry per eligible person with a maximum limit of (3) entries per eligible person during the Promotional Period. Post card entries must be sent and submitted individually with separate postage. NO PURCHASE IS REQUIRED TO ENTER. 

• Winner Selection: The Winners of the Giveaway will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period. The random drawing will be conducted about seventy-two (72) hours after the Promotion Period, and the drawings at that time are final. Odds of winning will vary depending on the number of eligible Entries received. 

• Winner Notification: Winner will be notified by email at the email address provided in the Entry Information in approximately (10) days after the random drawing. Potential Winner must accept a prize by email as directed by CES within (30) days of notification. CES is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a publicity release. No substitution or transfer of a prize is permitted except by CES.  

• Privacy: Any personal information supplied by you will be subject to the privacy policy of the Sponsor posted at https://www.cityelectricsupply.com/. By entering the Giveaway, you grant City Electric Supply permission to share your email address and any other personally identifiable information with the other Giveaway Entities for the purpose of administration and prize fulfillment, including use in a publicly available Winners list. 

• Publicity:  Except where prohibited by law, participation in the Promotion constitutes customer’s consent to the company’s and its agents’ use of the customer’s name, likeness, photograph, opinions and/or hometown and state for promotional purposes worldwide, for a period of one year from the end of the Promotion, in any and all media, manner, and formats now known or hereafter devised, without further payment or consideration.

• General Conditions:  This offer is valid only during the Promotion Period, while supplies last. Qualifying Purchases are subject to availability. Purchases of Qualifying Purchases via any channel other than any of the Qualifying Locations are not eligible for this promotion.

• Other Restrictions: This offer is void where prohibited or restricted by law. CES is also not responsible for any loss, destruction, or theft of your Qualifying Purchase. CES reserves the right to change without notice the Terms and Conditions of this promotion or modify or end this promotion at any time without notice.

1. Right to Verify. Company reserves the right, in its sole discretion, to verify any element of any entry or related materials, request additional information and to disqualify any Customer whose participation may subject Company or Company’s customers to controversy, negative publicity, scorn or ridicule.

1. Disputes: PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT CUSTOMER’S LEGAL RIGHTS, INCLUDING CUSTOMER’S RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR CUSTOMER’S CLAIMS. Except where prohibited, Customer agrees that any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved exclusively by binding arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by Customer with regard to this Promotion, but in no event shall include attorneys’ fees, or punitive, incidental, consequential or other damages.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Customer and Company in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas to this Promotion.
